The Heritage Todd Creek Metropolitan District is a local government organized pursuant to the Colorado Special District Act, which provides certain public facilities and services to the Heritage Todd Creek community. The District owns and maintains the vehicle access gates installed at the three entrances (Yosemite, Ehler and Quebec) into the Heritage Todd Creek community, which serve the purpose of providing security for the community and its residents. The gates (and other District-owned public improvements) are financed with federal and state tax-exempt bonds, repaid by pledged District property tax revenues, maintained with tax revenues, and thus are subject to certain tax laws affecting public purpose access. In consultation with its bond and tax attorneys, the District adopted the above gate closure rules which balances the security of the community and the requirements to maintain compliance with the District’s tax-exempt bonds and tax-funded operations.
